PoFA Keeper Liability: What Registered Keepers Need to Know
PoFA is the law private parking companies may use to pursue a registered keeper when they do not know who was driving. Operators still need to meet strict conditions.
What is PoFA?
PoFA means the Protection of Freedoms Act 2012. Schedule 4 is the part often used by private parking companies when they want to hold a registered keeper liable for a parking charge.
What keeper liability means
Keeper liability means the operator may be able to pursue the registered keeper if the driver is not identified. But the notice must meet the requirements, and the land must be relevant land.
What if PoFA does not apply?
If PoFA does not apply, the operator may need to pursue the driver rather than simply transferring liability to the registered keeper. That is why driver identity and appeal wording matter.
Why deadlines and wording matter
Timing, mandatory wording, notice content and evidence can all matter. A late or defective notice may affect keeper liability, depending on the facts.
